Terms & Conditions

Welcome to Charming Little Day LLC. By booking our services, the "Renter" agrees to the following terms and policies. These are designed to ensure the safety of your guests and the integrity of our equipment.

1. Booking & Payments

  • Deposit: A 50% non-refundable deposit is required to secure your event date.

  • Final Balance: Due no later than 72 hours prior to the event. Failure to pay may result in cancellation and forfeiture of the deposit.

  • Right to Refuse: We reserve the right to refuse service if setup conditions are unsafe (e.g., uneven ground, pet waste, or hostile behavior). In these cases, payments remain non-refundable.
     

2. Cancellation & Rescheduling

  • 14+ Days Notice: You may reschedule once within 6 months (subject to availability).

  • 7–13 Days Notice: Deposit is forfeited, but a one-time reschedule is allowed within 6 months.

  • Less than 7 Days Notice: Deposit is forfeited; rescheduling is not guaranteed.

  • Within 48 Hours: Full payment is required.
     

3. Weather & Safety Policy

We prioritize safety and equipment integrity. A backup indoor location is strongly recommended.

  • Rain & Wind: No outdoor setups if the forecast predicts a 15% chance of rain or higher, or winds/gusts exceeding 15mph.

  • Summer (June 1–Aug 31): Fully shaded setup areas are mandatory. Vegan leather reaches unsafe temperatures in direct sunlight.

  • Winter (Oct 1–Mar 31): No outdoor setups if temperatures are below 40°F.

  • Snow & Ice: All pathways and setup areas must be cleared and salted.

  • Thresholds: These policies apply based on the National Weather Service forecast at the time of delivery, regardless of conditions at the moment of arrival.


4. Delivery & Venue Requirements

  • Access: We require clear, unobstructed access to the setup area. Delays over 15 minutes due to restricted access may incur a $50 fee per 30 minutes.

  • Surfaces: Setup must be on flat, dry, level ground.

  • Fire Safety: Setups must be at least 15 feet away from open flames, grills, or fire pits.

  • Permits: The Renter is responsible for all venue permits, parking fees, or loading dock costs.


5. Equipment Care & Prohibited Items

To maintain hygiene and prevent permanent damage, the following are strictly prohibited in the play area:

  • The "No-Go" List: No food, drinks, gum, shoes (socks only!), animals, or "messy" materials.

  • Permanent Damage: No face paint, slime, glitter, silly string, markers, or pens.

  • Cleaning Fees: If equipment requires more than standard sanitization, the following fees apply:

    • $50: Minor cleaning (crumbs/light spills)

    • $100–$150: Moderate to heavy cleaning (mud/adhesives)

    • Full Replacement Value: Severe damage, punctures, or permanent staining (face paint/slime).


6. Supervision & Age Limits

  • Supervision: Continuous adult supervision (18+) is mandatory. Charming Little Day LLC does not provide supervision.

  • Age Limit: Equipment is exclusively for children aged 6 months to 4 years (unless otherwise approved in writing).


7. Media Release

The Company may photograph or film the equipment setup prior to the event start for marketing purposes. No guests or participants will be filmed. You will have the option to opt-out of this provision during the booking process.


8. Legal Terms

  • Governing Law: This Agreement is governed by the laws of the Commonwealth of Massachusetts.

  • Attorney’s Fees: In any dispute requiring legal action, Charming Little Day LLC shall be entitled to recover reasonable attorney’s fees and costs from the Renter.
